Terms of Service

By using Sufficiently Advanced Magic (operated by Esposito Holdings, LLC), you agree to the following terms. Please read them carefully.

Account Terms

• You are responsible for maintaining the security of your account and password.
• You are responsible for all content posted and activity that occurs under your account.
• You may not use the service for any illegal purpose or to violate any laws.
• You must be a human. Accounts registered by "bots" or other automated methods are not permitted.

Payment, Refunds, and Plan Changes

• If you are using a free trial, no credit card is required and no charges will be made until the trial period ends.
• All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities.
• For any upgrade or downgrade in plan level, your credit card will automatically be charged the new rate on your next billing cycle.
• Refunds are governed by our Fair Refund Policy.

Cancellation and Termination

• You are solely responsible for properly canceling your account. An email or phone request to cancel your account is not considered cancellation.
• All of your content will be deleted within 30 days from our servers upon cancellation. This information can't be recovered once it has been permanently deleted.
• If you cancel the service before the end of your current paid up month, your cancellation will take effect at the end of that billing period, and you will not be charged again.
• We reserve the right to suspend or terminate your account and refuse any and all current or future use of the service for any reason at any time. We will make a good faith effort to provide advance notice in cases of termination that aren't caused by a violation of these terms.
• Any abusive behavior toward our staff will result in immediate termination of your account.

Modifications to the Service and Prices

• We reserve the right at any time to modify or discontinue, temporarily or permanently, any part of the service with or without notice.
• Prices of all services are subject to change with 30 days notice. Such notice may be provided at any time by posting the changes to our website or the service itself.
• We shall not be liable to you or to any third-party for any modification, price change, suspension, or discontinuance of the service.

Uptime, Security, and Privacy

• Your use of the service is at your sole risk. We provide this service on an "as is" and "as available" basis. We do not offer service-level agreements for uptime or availability.
• We take many measures to protect and secure your data through backups, redundancies, and encryption. We enforce encryption of data in transit and at rest.
• We use third-party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run the service. These include Amazon Web Services (infrastructure), Stripe (payment processing), and Auth0 (authentication).
• When you use our service, you entrust us with your data. We take that trust seriously. See our Privacy Policy for details.

Copyright and Content Ownership

• We claim no intellectual property rights over the data you provide to the service. Your data is yours.
• We do not permit the reproduction, duplication, copy, sale, resale, or exploitation of any portion of the service, use of the service, or access to the service without express written permission.

Features and Bugs

• We design our services with care, based on our own experience and feedback from customers. However, there is no guarantee that our services will meet your specific needs.
• We test all of our features extensively before shipping them. As with any software, our services inevitably have some bugs. We track the bugs reported to us and work through them in priority order. Not all reported bugs will get fixed immediately.

Liability

You expressly understand and agree that Sufficiently Advanced Magic shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses resulting from: (i) the use or the inability to use the service; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information, or services purchased or obtained or messages received or transactions entered into through or from the service; (iii) unauthorized access to or alteration of your transmissions or data; (iv) statements or conduct of any third-party on the service; (v) or any other matter relating to these terms of service or the service, whether as a breach of contract, tort (including negligence whether active or passive), or any other theory of liability. The use of the service is at your sole risk.
